User Security and Confidentiality Agreement
This Agreement applies to all employees, contractors, subcontractors, volunteers, and other partners who are authorized to use the Social Services and Health Information Exchange (SSHIE) of the Los Angeles County (County) Department of Health Services (DHS), whether permanent, temporary, part-time, or in any other status. Only authorized users are permitted to use the DHS SSHIE through CHAMP*or other IT platforms. This comprises the entire Agreement between the user and DHS and supersedes any prior agreements pertaining to the subject matter herein.
As an authorized user of the DHS SSHIE through CHAMP, I agree to the following: - The DHS SSHIE, of which CHAMP is a component, is the property of the County. I will use the DHS SSHIE only for the use and exchange of social services and health information (Community Health and Integrated Program, (CHIP) Data) between partners in CHIP, which include Whole Person Care (WPC), Housing for Health (HfH), Office of Diversion Re-entry (ODR), Countywide Benefits Entitlement Services Team (CBEST), and the Care Transitions Unit in Correctional Health Services (CTU-CHS) and with other persons and entities as permitted by the consent form. I will not send, disseminate, or otherwise expose or disclose to any person or organization, any personal and/or confidential information, unless authorized to do so as part of my job responsibilities and in accordance with law.
- I will view and share records only as needed to fulfill my duly assigned job functions or duties for these programs and access only the minimum necessary information required for my job functions or duties. The purposes for which I may view, use, and disclose CHIP Data are based on my job responsibilities as established by the program that I support. I am solely responsible for understanding my job responsibilities and the permitted uses of CHIP data. I will use the DHS SSHIE, including CHAMP, in accordance with the DHS SSHIE and CHAMP policies and procedures, as well as any policies, standards, and procedures of my program. Personal, non-County business, and/or unauthorized use or access of CHIP Data is forbidden.
- I will have access to confidential health and social services client information for which there is an expectation of privacy. I will protect, secure, and keep confidential all such information in compliance with all applicable federal, state, and local laws, rules, regulations, ordinances, guidelines, directives, policies, and procedures relating to confidentiality and information security, including but not limited to the Health Insurance Portability and Accountability Act and its implementation regulations at 45 C.F.R. Parts 160 and 164, the Confidentiality of Medical Information Act at California Civil Code 56 et. seq, the Lanterman Petris Short Act at California Welfare and Institutions Code § 5328, the state and federal substance abuse confidentiality rules at California Health & Safety Code § 11845.5 and § 11812(c) and 42 C.F.R. Part 2, State laws governing the confidentiality of HIV data at California Health & Safety Code §§ 120975-120985, and State laws governing Personal Information at Cal Civil Code § 1798.29.
- If I receive access to confidential health and social services data because of my role as a care team member for CHIP clients, I hereby attest that I am or will be involved in consultation, diagnosis, evaluation, and/or treatment (which includes care coordination) for these clients.
- I will comply with County and Department and program guidelines, directives, policies, and procedures relating to data confidentiality and information security. I will comply with the terms of any applicable data sharing agreement and/or security and privacy agreements of my organization, Department, or program.
- I will not subvert or bypass any security measures which have been implemented in order to control or restrict access to CHAMP, nor will I attempt to use CHAMP in order to gain unauthorized access to any other computer systems or networks.
- I am responsible for maintaining the secrecy of my CHAMP User ID and password, and I am fully responsible for all activities that are conducted under my User ID and password. I will not permit others to use my User ID or password in order to access CHAMP, and I will not use another person’s User ID or password. I will not keep or maintain any unsecured record of my password, whether on paper, in an electronic file, or otherwise. If my User ID and password have been compromised or I suspect improper/unauthorized access, I will immediately change my password and notify my immediate supervisor and the DHS’ Security and Privacy Officer at 213-288-7741 of any unauthorized use of my User ID and password.
- I will not leave my workstation unattended while in active logon status to CHAMP. When I leave my workstation, I will either lock the workstation or logoff from CHAMP.
- I will notify my immediate supervisor and the DHS’ Security and Privacy Officer at 213-288-7741 upon the discovery of an actual or suspected security breach of CHAMP.
- I am responsible for the accuracy of the data that I enter into CHAMP. Only data that is, to the best of my knowledge, correct may be entered into CHAMP. I must notify my immediate supervisor, and if necessary, my chain of command, if I am ever requested to knowingly enter incorrect data.
- It understand that it is illegal for me to knowingly access CHAMP to add, delete, alter, damage, destroy, copy, or otherwise use CHIP Data in order to defraud, deceive, extort, or control data for wrongful personal gain or any other unlawful purpose. It is also illegal for me to knowingly disrupt, damage, or degrade CHAMP system performance or introduce any malicious software, virus, or other contaminant.
- I am not permitted to access, copy, or disclose any software, code, or related documentation from CHAMP to any individual or organization without specific written DHS management authorization.
- My activities related to access and use of CHAMP may be monitored or investigated at any time for any lawful purpose, including for a disciplinary or civil action and criminal prosecution, without notice or consent. I understand that County may disclose, as it deems necessary, my activity on CHAMP without my notice or consent. CHAMP has the right to terminate my account at any time for any reason.
- If my employment, contracting relationship, or other affiliation with County ends, I will not subsequently access, use, or disclose any CHIP Data to any third party. My obligations for the confidentiality of CHIP Data will survive the termination of this Agreement.
I recognize that my failure to abide by this Agreement and fulfill my security and confidentiality responsibilities could result in the abuse of County information resources and data, and that the County may hold me responsible for such abuse. Wrongful access, inspection, use or disclosure of confidential information for personal gain, curiosity, or any non-business related reason is a crime under State and federal laws, including, but not limited to, the provisions of California Penal Code Section 502(c).
I further understand that my non-compliance with any provision of this Agreement may result in termination of my access to CHAMP, disciplinary action, and/or other actions (e.g., suspension, discharge, denial of access, and termination of contracts), as well as both civil and criminal penalties and that the County may seek all possible legal redress.
*CHAMP is the Los Angeles County Department of Health Services (DHS) Comprehensive Health Accompaniment Management Platform (CHAMP) and is a component of the DHS Social Services and Health Information Exchange (SSHIE).
Access and use of this system is restricted to authorized personnel. Unauthorized access or use may subject violators to criminal, civil, and/or administrative action. I am an authorized user of the DHS Social Service and Health Information Exchange through CHAMP. I have read and understand the terms of the User Security and Confidentiality Agreement and I hereby accept and agree to comply with such terms.
